Terms of Service Agreement

Program: Private Practice Success Membership (“Membership,” “Program,” or “Service”)
Governing Law: State of Colorado

1. Welcome

Welcome to the Private Practice Success Membership!

We’re honored by your interest in joining this professional community. This program is part of Growing Self, LLC’s ongoing mission to create affirming, ethical, and empowering spaces for therapists and coaching professionals to connect, grow, and thrive.

This Agreement (“Agreement”) outlines the mutual rights, responsibilities, and expectations of all participants. It is designed to foster transparency, professionalism, and shared accountability between Growing Self and participating clinicians.

By enrolling, you agree to the following terms and to uphold the highest standards of your profession.

2. Purpose of the Program

The Private Practice Success Membership is an advanced professional membership that combines two components:

  1. The Growth Collective — a professional homebase offering:

    • Ongoing consultation groups (“Homebase Groups”)

    • Continuing education (CE) opportunities

    • A supportive professional community

    • Success coaching and mentorship

    • A dynamic referral and collaboration network

  2. Private Practice Success Services — a premium referral partnership that provides:

    • Direct client bookings (average of 5–10 per month)

    • Targeted client matching based on areas of competency

    • Optional access to administrative and technical support services

Together, these two elements provide both professional support and practical practice-building tools to help licensed clinicians create thriving, sustainable practices.

3. Automatic Enrollment in The Growth Collective

All clinicians who participate in the Private Practice Success Membership are automatically enrolled in The Growth Collective.

Participation in The Growth Collective is required to maintain active standing in the Success Membership.

Members must:

  • Attend at least three (3) Homebase Group sessions during each six-month period.

  • Engage meaningfully in consultation and community activities.

  • Maintain good standing by upholding Growth Collective ethical and professional standards.

If a clinician fails to meet these participation requirements, Growing Self reserves the right to pause or revoke their Private Practice Success Membership.

4. Eligibility Requirements

Participation is limited to fully licensed therapists in good standing who meet the following criteria:

✅ Hold an active professional license to practice psychotherapy or counseling in their state.
✅ Maintain active malpractice insurance coverage (minimum $1M/$3M recommended).
✅ Maintain ethical and legal standing with their professional board(s).
✅ Hold one of the following coaching credentials (if providing coaching services):

  • BCC (Board Certified Coach)

  • ICF (Associate, Professional, or Master Certified Coach)

  • Certified Career Coach designation
    ✅ Actively participate in The Growth Collective’s community and educational programming.
    ✅ Demonstrate professional competence and alignment with the values of Growing Self.

Growing Self reserves the right to verify credentials and discontinue participation if these requirements are not met.

5. Program Structure & Scope of Services

Included in Your Membership

  • Full participation in The Growth Collective community

  • Consultation and peer supervision opportunities

  • Ongoing access to CE-accredited professional training

  • Private Practice Success referral and booking support

  • Success coaching and practice growth guidance

  • Access to a network of trusted peers and potential referral partners

Not Included

  • Clinical supervision

  • Therapy or treatment for members

  • Legal, tax, or business representation

  • Guaranteed client volume or income

The program is designed as a professional development and referral partnership, not an employment or supervisory relationship.

6. Client Referral & Booking Services

Growing Self functions as a marketing and referral platform to help clients connect with qualified clinicians.

We provide client referrals and booking services based on client needs and clinician expertise.

Referral Guidelines

  • Clinicians can expect an average of 5–10 new client consultation bookings per month.

  • Clients book directly into the clinician’s calendar using our scheduling system.

  • Clinicians must keep availability up-to-date and notify our team promptly of any scheduling changes.

  • Once a client is booked, the clinician fully owns that relationship and is responsible for all ongoing communication, documentation, and billing.

Competency Matching

Clients are only referred to clinicians who have demonstrated appropriate expertise or credentialing in the presenting issue (e.g., career coaching, couples counseling, trauma recovery).

The Program and Practice Services Manager reviews clinician credentials and training to ensure accurate and ethical client matching.

Growing Self does not access, store, or transmit Protected Health Information (PHI).

7. Professional Responsibility & Independence

All clinicians in this program are independent practitioners, not employees, contractors, or agents of Growing Self.

Each member agrees to:

  • Maintain appropriate licensure and insurance coverage.

  • Uphold ethical codes of their licensing and credentialing boards.

  • Accurately represent their qualifications and services.

  • Accept full responsibility for client care and professional outcomes.

Growing Self assumes no liability for clinical decisions, client results, or practice management conducted by participating clinicians.

8. Confidentiality & Privacy

Confidentiality and professionalism are core to our values.

All members agree to:

  • Maintain strict confidentiality regarding case discussions and personal disclosures in Homebase groups or CEU events.

  • Avoid sharing identifying client details.

  • Never record, distribute, or reproduce group discussions or materials without written permission.

While Growing Self upholds confidentiality standards, we are not a HIPAA-covered entity. Each clinician remains individually responsible for compliance with HIPAA and other relevant privacy laws.

9. Membership Fees & Terms

Membership Options

  • Six-Month Agreement: $899/month

  • Twelve-Month Agreement: $799/month

Terms

  • Fees are billed monthly by automatic subscription.

  • There are no refunds for partial or unused membership periods.

  • After the initial term, membership may transition to month-to-month with 30 days’ written notice.

Membership includes full participation in The Growth Collective and Private Practice Success booking services.

10. Pausing, Cancellation, & Discontinuation

  • To discontinue membership, 60 days’ written notice is required.

  • Incoming client referrals can be paused with one week’s notice.

  • Re-activation requires two weeks’ notice.

  • Activation or deactivation of client booking may occur only once per month.

  • Paused months are still billed unless the member transitions to a month-to-month agreement.

  • Non-participation in The Growth Collective (fewer than three Homebase group sessions in six months) may result in membership suspension or revocation.

11. Performance & Ethical Standards

Growing Self reserves the right to pause or terminate membership if:

  • Ethical or professional violations occur.

  • Membership fees are unpaid.

  • Client feedback indicates consistent dissatisfaction or unprofessional conduct.

  • The clinician’s participation no longer aligns with the values of Growing Self.

In all cases, members will be notified in writing and given an opportunity to respond or remedy the situation.

12. Additional Practice Support Services

Optional practice support — such as administrative assistance, VA services, or IT support — is available at an hourly rate under separate service agreements.

These add-on services are billed separately and are not part of the standard membership.

13. Intellectual Property & Brand Representation

All educational materials, training resources, and digital content shared within The Growth Collective or Practice Success Program remain the intellectual property of Growing Self, LLC.

Members may not reproduce, distribute, or sell any materials without written consent.

Clinicians may refer to themselves as:

“A member of The Growth Collective through Growing Self, LLC.”

However, members may not use Growing Self’s logo, branding, or marketing assets in independent promotions or imply employment or partnership status.

14. Liability & Indemnification

Growing Self assumes no responsibility for clinical outcomes, financial performance, or client interactions.

Clinicians agree to hold harmless and indemnify Growing Self, LLC, its owners, and employees from any claims, damages, or legal actions arising from their participation or provision of services.

15. Dispute Resolution

This Agreement is governed by the laws of the State of Colorado.

In the event of any dispute, both parties agree to first attempt resolution in good faith through dialogue.

If unresolved, disputes will be settled through binding arbitration in Denver County, Colorado, in accordance with the American Arbitration Association rules.

16. Modification of Terms

Growing Self, LLC may amend these Terms periodically. Members will receive reasonable notice of material changes via email or member portal. Continued participation constitutes acceptance of updated terms.

17. Acknowledgment & Agreement

By enrolling in the Private Practice Success Membership, you confirm that you:
✅ Have read and understood this Agreement.
✅ Meet all eligibility, credentialing, and ethical requirements.
✅ Maintain current licensure and malpractice insurance.
✅ Understand that you are an independent practitioner responsible for your own client care and business outcomes.
✅ Agree to actively participate in The Growth Collective and uphold community standards.
✅ Consent to these Terms of Service in full.

🌿 What You’re Saying Yes To (Plain-Language Summary)

You’re joining a partnership designed to help you thrive — professionally and personally.

By saying yes, you agree to:

  • Stay licensed, insured, and in ethical standing.

  • Actively participate in The Growth Collective (attend at least 3 groups per 6 months).

  • Receive an average of 5–10 qualified client referrals each month.

  • Manage your own clients, billing, and practice operations.

  • Pay $799–$899/month with a 6–12 month minimum commitment.

  • Give 60 days’ notice if you wish to end your membership.

  • Treat this relationship as collaborative and professional private practic support system — not employment.

  • Uphold confidentiality, respect, and excellence in everything you do.
